Common questions after filing your BOC-3:

The document I received has a line for a signature. Do I need to print this out and sign it?

No. The purpose of this is if you had retained your own registered agents in each of the 50 states and D.C. and were filing the BOC-3 yourself. By having a blanket process agent file it on your behalf, you need only retain a copy for your records.

I noticed there is an expiration date at the top of the form. Does this mean I need to refile after that date?


No. That expiration date is for that version of the form being used for filing. This just means that the DOT should have released a new version of the form by then. It does not affect your filing status, which will be retained.

Is there anything that does change my BOC-3 status?


If you change your company’s name or address (including changes to the DBA) then you will need to refile the BOC-3. Please contact us if you do so we can refile it for you. We also offer name change and address change services. Other than that, your BOC-3 filing does not expire.

I got a letter telling me I need to file my BOC-3. Why am I getting this when I thought I had it done already?


Many companies will send out letters to every new FMCSA applicant. These are typically mailed out before the BOC-3 is filed, or they may only get a list of new applicants that isn’t updated even if the BOC-3 is filed immediately. Getting this does not mean your BOC-3 wasn’t filed.

As above, changing your company name or address will also reset your BOC-3 filing status with the FMCSA, so this can result in these letters being sent to you as well. Again, please contact our office and don’t end up paying for another BOC-3 unnecessarily.

I got my BOC-3 filed, so why have I still not been granted authority after 2 weeks?


Keep in mind that there is a minimum 10 day waiting period for granting authority, but 3 weeks is typical. Also, you must have your insurance filed with the FMCSA to get your authority. You should check with your insurance provider to ensure they know how to do this properly. If you don’t have insurance yet, we can refer you to agents we have worked with. It can also take more than a week from the time authority is granted to receiving the certificate in the mail.
