Lifetime BOC-3 – Required for all Interstate for Hire Carriers

DOT requires every Interstate Authorized For Hire Carrier operating under their own operating authority to have a current BOC-3 form on file with the office of motor carrier safety.

The BOC-3 form is a list of  process agents for each state, who, in the event of a legal action being presented against the motor carrier by an individual or legal entity from outside the carrier’s base state, would accept the papers being served on the carrier’s behalf and would then forward them to the carrier being served.  A BOC-3 must be filed with FMCSA before operating authority is granted.

The BOC-3 is filed under your company name exactly as it appears on DOT records.

Name changes cannot be completed through the BOC-3 process.

Each authority (eg MC, FF) must have its own BOC-3 filing.

Please ensure you are requesting a BOC-3 for the correct authority (MC or FF number).

The BOC-3 does not expire. However, if you change your name and/or address, a new BOC-3 filing is required per DOT.

With a Lifetime BOC-3, you will never be charged for a refiling which is required for registration errors, name change, address change or change of ownership.

Once filed, there is no refund.

The BOC-3 is filed electronically and is effective immediately and is emailed to you usually within one business day.

After the BOC-3 is filed, you will not get DOT operating authority until insurance is filed with DOT.

Only your insurance company can handle that filing.

BOC-3 Process Agents are NOT your Registered Agent. Please arrange for a Registered Agent separately with a person/entity providing that service.
